By accessing or using Sakebari's AI marketing platform, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services. These terms apply to all users, including visitors, registered users, and paying subscribers.

Sakebari is an AI-powered marketing platform that provides tools for creating marketing content including posters, videos, automated social media posts, and sales chatbots. Our platform uses artificial intelligence to generate content based on your brand guidelines and preferences.

User Accounts

To use our services, you must create an account. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Providing accurate and complete registration information
Notifying us immediately of any unauthorized access

You must be at least 18 years old to create an account and use our services.

Acceptable Use

You agree not to use Sakebari to:

Create content that is illegal, harmful, or violates others' rights
Generate misleading, deceptive, or fraudulent marketing materials
Infringe on intellectual property rights of third parties
Distribute malware or engage in unauthorized access attempts
Resell or redistribute our services without authorization
Use automated systems to abuse or overload our platform

Social Media & Third-Party Platforms

Sakebari allows you to connect your accounts from third-party platforms, specifically Meta (Facebook and Instagram). By using these integrations, you agree that:

You are solely responsible for compliance with the terms and policies of the respective third-party platforms, including Meta's Platform Terms and Developer Policies.
You authorize Sakebari to access, retrieve, and store data from these platforms in accordance with your permission settings.
You are responsible for any content published or messages sent through our platform to these third-party services.
Sakebari is not responsible for any actions taken by third-party platforms (e.g., account suspension, API changes).

For AI-powered messaging, you acknowledge that while our AI strives for accuracy, you are responsible for monitoring and supervising automated interactions with your customers.

Our use of information received from Meta APIs adheres to the Meta Platform Terms and Developer Policies. You may revoke our access at any time through your Facebook or Instagram settings, or by disconnecting in Sakebari's Integrations page.

Intellectual Property

Your Content: You retain ownership of all content you upload to Sakebari, including brand assets, logos, and images. You grant us a limited license to use this content solely to provide our services to you.

Generated Content: Content generated by our AI tools using your brand assets belongs to you. You may use this content for any lawful business purpose.

Our Platform: The Sakebari platform, including our AI technology, design, and features, is our intellectual property and is protected by copyright and other laws.

Subscription and Payment

Sakebari offers both free trials and paid subscription plans. By subscribing to a paid plan:

You authorize us to charge your payment method on a recurring basis
Subscription fees are billed in advance and are non-refundable
You may cancel your subscription at any time, effective at the end of your billing period
We reserve the right to modify pricing with 30 days' notice

Limitation of Liability

Sakebari is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of our platform. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Termination

We may terminate or suspend your account immediately, without notice, for any violation of these Terms. Upon termination, your right to use the service ceases immediately. You may export your data before termination by contacting our support team.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes via email or through our platform. Your continued use of Sakebari after changes constitutes acceptance of the updated terms.

Service Availability

We strive to maintain high availability of our platform, but we do not guarantee uninterrupted service. We may temporarily suspend access for:

Scheduled maintenance (with advance notice when possible)
Emergency repairs or security updates
Circumstances beyond our reasonable control

We are not liable for any losses resulting from service interruptions.

Dispute Resolution

Any disputes arising from these Terms or your use of Sakebari shall first be resolved through good-faith negotiation. If we cannot resolve the dispute within 30 days, either party may seek resolution through binding arbitration or in the courts of the applicable jurisdiction. You agree to waive any right to participate in class action lawsuits against Sakebari.

Governing Law

These Terms of Service shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any legal action or proceeding shall be brought exclusively in the courts of competent jurisdiction.
